What are your rights as a car accident victim? According to Nebraska law, if you suffered serious injury as the result of a car accident caused by someone else, you can file a claim for damages including:
- Medical costs – including hospital bills and other medical treatment
- Property damage
- Pain and suffering,
- Lost wages and, if your injury prevents you from returning to work, lost earning capability
- Injuries that cause the death of a loved one may also be grounds for a wrongful death suit
Just because you have the right to file a claim for these damages, however, does not mean you will automatically receive the compensation you deserve without proper representation. Insurance companies – even your own – aren’t in the business of paying out large sums of money to you. Their goal is to minimize damages and pay you the least amount of money possible, which is why an attorney is often able to obtain a more fair settlement than you could on your own.
